What is the difference between the PBCA and the ACC portfolios?

In administering the annual contributions contracts (ACC), CHFA monitors and enforces compliance with the HAP contract. As a performance-based contract administrator (PBCA), CHFA monitors PCBA contracts, holding the properties to more stringent guidelines. CHFA is paid by HUD based on PCBA monitoring performance as opposed to just receiving the ACC flat fee.

As a contract administrator, CHFA is paid a fee by HUD to:

  • Conduct management and occupancy reviews that include annual site visits
  • Adjust contract rents and utility allowances
  • Process expiring HAP contracts, renewals, opt-outs, and terminations
  • Pay monthly housing assistance payments to owners
  • Respond to health and safety issues
  • Submit annual HAP budgets and year-end settlement statements to HUD
  • Submit CHFA's audit to HUD
  • Report progress on contract performances to HUD
  • Follow up on REAC inspections

How does the Section 8 subsidy work?

Section 8 is a federal housing subsidy program for low income households created by Congress in 1974. Qualifying residents pay 30% of their adjusted gross income in rent. The difference between that amount and the actual rent is reimbursed to the property owner by the U.S. Department of Housing and Urban Development (HUD). CHFA oversees and administers slightly over 300 Section 8 contracts in Colorado. 
 
Eligibility is based on household income and other factors.
 
Section 8 subsidies are available for tenant-based and project-based programs. The tenant-based program lets low income households use the subsidy in a rental housing unit of their choice, provided the facility accepts tenant-based vouchers. A project-based subsidy is tied to a specific rental property, so that an eligible person or household renting at that development receives the subsidy while living there. 

Who approves affirmative fair housing marketing plans – CHFA or HUD?

The plan should be submitted to HUD for approval; however, CHFA may write a finding if no approved plan is onsite at the time the management and occupancy review is completed. 

What is the difference between a funding renewal and a contract renewal? 

When the contract period expires, the contract must be renewed. Multiple-year contracts, once approved, must be followed up with an annual “funding renewal” or “rent adjustment” submission throughout the life of the contract.
 
This lets Congress provide multi-year contracts, even though Congress can only allocate funding for contracts one year at a time. The annual funding renewal or rent adjustment requests the funds allocated for that year.

I am a property owner and want my property considered for the Section 8 voucher program.  What should I do?

Contact the housing authority in the county in which the property is located

I own a property that’s under a Section 8 contract. I have not received the month’s HAP payment.  What is the problem?

If your contract has been renewed and if your voucher has been submitted accurately and on-time and approved, the most likely reason for the delay is that CHFA has not received funds from HUD to make the payment, probably because of a shortfall in availability of federal funds.
