Post Closing IssuesE-Recorded DocumentsE-recordings are becoming increasingly popular with title companies and lenders alike. However, CHFA must receive the actual original recorded document of the Deed of Trust and Assignment, or a certified copy of the recorded document. An E-Recorded Deed of Trust, even with a coversheet that states ‘Attached to this notice is the copy of the electronically recorded document, which serves as proof of recording and serves as your original', is not acceptable to CHFA. Deed of Trust Tax Exempt Financing Rider The CHFA HomeOpener and CHFA HomeOpener Plus Programs do not require a Tax Exempt Financing Rider to be attached to the Deed of Trust. However, CHFA has recently noticed that many Deeds of Trust for these programs indicate such a rider is attached, while the rider is actually not attached. This error renders the Deed of Trust inaccurate, and requires a modification and re-recording of the document. CHFA will suspend the Mortgage Loan and charge a Suspension Penalty of 0.25% OPB. The ensuing delay to have the document corrected could result in additional penalties; if the suspension is not resolved prior to Reservation Expiration, CHFA may decline to Purchase the Mortgage Loan.
