CHFA Updates the Compliance Submission Voucher Form 700All Participating Lenders warrant to CHFA under existing agreements and the Seller’s Guide that they are in compliance with applicable state and federal laws. Each Participating Lender must determine independently whether and to what extent it is subject to the Colorado Mortgage Broker Licensing Act Compliance C.R.S. Section 12-61-901, et. seq.The new CHFA Form 700 Compliance Review and Submission Voucher and File Order includes the following statement: “By submission of this document, the Participating Lender affirms that it is in compliance with the Colorado Mortgage Broker Licensing Act (the “Act”) and has either provided to the Borrower(s) the disclosures required by the Act or asserts that it is exempt from the requirement to provide one or more of said disclosures.” CHFA will not be collecting copies of disclosures that Participating Lenders have provided in compliance with this Colorado law. The Participating Lenders should retain such copies in accordance with their own document retention standards.
